Personal Data

ITESOFT may need to gather information about the Visitor, such as name, job title, professional contact details, email address, etc., in order to assist the Visitor with his or her request (registering for a seminar, setting up a meeting, request for documentation/information, etc.) and to help ITESOFT gain a better knowledge of the Visitor, contact the Visitor, or ensure that the Visitor is able to benefit from any special promotions or communications.

Whenever the Visitor completes a questionnaire/form on the Site, or whenever the Visitor sends an email to ITESOFT:


  • in accordance with article 27 of Act 78-17 dated 6 January 1978 governing information services, data files and freedom of information, the Visitor is informed whether his or her answers are voluntary or compulsory in nature;
  • the information provided is intended for use by ITESOFT in its customer/contacts data files. The information may be communicated to third parties (ITESOFT commercial partners). Visitors may withhold permission for their information to be passed on to others.

ITESOFT warrants that all nominative data submitted via the Site will be treated in accordance with Act 78-17 dated 6 January 1978 governing information services, data files and freedom of information. ITESOFT expressly undertakes to inform persons who have submitted data of their rights and to do its utmost to protect information of a personal nature, and, in accordance with article 29 of Act 78-17 dated 6 January 1978, especially to ensure that data is not misrepresented, damaged, or communicated to unauthorised third parties.

Under articles 26, 34 and 36 of Act 78-17 dated 6 January 1978 governing information services, data files and freedom of information, Visitors have the right to:


  • deny permission for nominative information to be processed if they can show due cause;
  • see and receive a copy of nominative information concerning them;
  • rectify, modify and delete nominative information concerning them.

Consultable Information

As owner of the intellectual property rights, ITESOFT has opened the Site for the purposes of Visitor information only; ITESOFT authorises Visitors to consult the online Site for their personal requirements alone. Visitors are required to contact ITESOFT if they wish to use the Site for any other purpose.

The information contained in the Site, and more generally all the elements that it comprises, are made available to the Visitor as guidance only. In no sense can the information be construed as being an offer for sale, a licence, a recommendation, or any other commercial relationship between the Visitor and ITESOFT.

No reproduction, representation, disclosure, distribution, adaptation, translation or modification, whether partial or entire, nor transfer to another site, even for non-commercial purposes, and irrespective of the medium and/or process employed, may be made without prior written approval from ITESOFT.

The data, or elements of it, presented on the Site may not be used for commercial purposes of any nature whatsoever without prior written approval from ITESOFT.

No link may be made to the Site without prior written approval from ITESOFT.

Violation of any of the author's copyright constitutes forgery and will open the perpetrator to civil and criminal proceedings.

Visitor Undertaking and Conditions of Use for the Site

The Visitor accepts that all elements presented on the Site are protected by copyright and/or other forms of industrial property rights; the Visitor undertakes to fully respect the rights cited above.

ITESOFT does not warrant the Site to be fit for any specific Visitor requirement or particular use. All information contained in the Site is provided on an "as is" basis, without guarantee of any sort. ITESOFT does not offer any implicit guarantee as to the quality, topicality, ownership or absence of counterfeiting for any of the information presented on the Site.

ITESOFT can in no way be held responsible for errors or omissions regarding the Site's content or resulting from use of the information contained in the Site, nor for access speeds and conditions, service non-availability or interruption, nor for damages occasioned to the Visitor directly or indirectly consequent to using the Site or the information contained therein.

Visitors who supply information other than personal information as understood by the terms of Act 78-17 dated 6 January 1978 governing information services, data files and freedom of information, hereby grant to ITESOFT all transferable rights relating to said information and authorise ITESOFT to use said information as best it sees fit. Visitors warrant that the information provided does not infringe the intellectual property rights of third parties nor any other applicable legislation.

ITESOFT may terminate or modify the nature of the services and/or conditions governing the use of the Site at any time and without notice being required.

The Visitor declares that she or he is aware of the technical risks inherent in the Internet network and acknowledges that no site can be kept safe from intrusion by unauthorised third parties and may become harmed as a result; that information circulating on the Internet is susceptible to interception by third parties and that under these circumstances ITESOFT is unable to guarantee that Visitors will not be victim of such actions.

If the Site contains hyperlinks to websites under the control of third parties: ITESOFT has no control over these sites and cannot accept any responsibility for their content (notably for their truthfulness, topicality, quality, operation, comprehensiveness and relevance) nor for the use to which they may be put. Insertion of said hyperlinks in no way implies that ITESOFT approves of the elements contained in these sites.

Use of the Site, and these terms and conditions of use, are governed by the laws of France. The Commercial Court at Nimes shall be the only competent tribunal before which disputes may be heard where no amicable agreement between ITESOFT and the Visitor is possible.
